Candy4u Subscription Terms and Conditions

These Subscription Terms and Conditions ("Terms") apply to your subscription for Candy4U ("Subscription" or "Service") operated by IPOC Limited T/A Candy4U (company number: 15977097), whose trading address is Unit 8 Wapping Park, Gresley Road, South West Industrial Estate, Peterlee, United Kingdom, SR8 2FD ("we", "us", "our"). By subscribing, you confirm that you accept these Terms in full. If you do not agree, do not subscribe.

1. Subscription Service, Contents and Variation
1.1 When you subscribe, you will be asked to select your preferred candy categories or dietary preferences. Each month we will send you a curated mix of candy items from within those preferences.

1.2 We may from time to time substitute individual items with ones of equivalent value or type depending on stock, supplier change, or discontinuation.

1.3 Repetitions of particular items may occur across months depending on availability.

1.4 Subscriptions are provided on a rolling monthly basis unless otherwise stated at the time of purchase (for example, fixed-term promotional subscriptions). This means your subscription will automatically renew each month on the same billing date using your selected payment method until you choose to pause or cancel. You can cancel at any time prior to your next billing date to avoid being charged for the following month. We will make the recurring nature of your subscription clear at checkout and in your confirmation email, in accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 and CMA guidance.

1.5 We reserve the right to change box size, frequency, product mix, or delivery method, but if these changes are material, we will notify you in advance and give you an opportunity to cancel before the change takes effect.

2. Price, Billing and Payment
2.1 All subscription prices are quoted in GBP (£) and inclusive of VAT (if applicable).

2.2 When subscribing you authorize us to collect recurring payments monthly via your selected payment method.

2.3 The subscription renews automatically every month on the same calendar date (or nearest valid date).

2.4 If we are unable to collect payment due to failed card or expired card, we may suspend the service or cancel the subscription if you do not remedy the payment issue within a reasonable time.

2.5 We reserve the right to increase prices or change fees, but we will give you at least 30 days’ prior notice before the change, and you may cancel before it takes effect.

3. Delivery, Shipping and Risk
3.1 We currently deliver to customers in the UK only (England, Scotland, Wales, Northern Ireland).

3.2 We use Royal Mail or a courier service to dispatch packages. Delivery times are estimates only and not guaranteed unless we specify otherwise.

3.3 Title to, and risk in, the goods pass to you when delivered to the address you provided.

3.4 If a parcel is lost, damaged or delayed beyond a reasonable period, notify us promptly. We will arrange a replacement at no extra cost, subject to verification.

3.5 You must inspect goods upon delivery and notify us of any problems within 14 days of delivery to preserve your rights.

4. Returns, Refunds and Cancellations
4.1 Statutory 14-day cancellation right
Under the Consumer Contracts Regulations, you have the right to cancel a distance contract within 14 days of receipt of goods (or for multiple deliveries, within 14 days of the last delivery). You do not have to give a reason.

4.2 Returns
You may return goods within that 14-day period at your cost unless we agree otherwise, provided they are unused, unopened and in saleable condition. If you return the goods in full compliance, we will refund you the price of those goods within 14 days of receipt of the return or proof of posting.

4.3 Perishable goods
The 14-day cancellation right does not apply where goods are perishable or likely to deteriorate rapidly, for example confectionery. In such cases, the right to cancel may be lawfully excluded once delivery has taken place. We will make this clear at the point of purchase.

4.4 Faulty or misdescribed goods
Even after the cancellation period, you retain rights under the Consumer Rights Act 2015. We must supply goods that are as described, of satisfactory quality and fit for purpose. If the goods are faulty or not as described, you may request a repair, replacement or refund as appropriate.

4.5 Subscription cancellation
You may cancel your subscription at any time prior to the next billing date. If you cancel after payment has been taken, you will still receive that month’s box but no refund will be issued for that payment.

5. Pausing or Skipping Deliveries
5.1 You may pause or skip one or more boxes in advance of their billing date, subject to a cut-off deadline (for example, 48 hours before shipment).

5.2 To cancel, pause or skip, you may use your account dashboard or contact us by email or another method we make available.

6. Cancellation Rights
6.1 To exercise your statutory cancellation right, you must inform us by email or in writing before the end of the 14-day period. You may use a standard cancellation form, though this is not mandatory.

6.2 Refunds will be processed within 14 days after we receive the returned goods or evidence of their return. We may withhold the refund until goods are received.

6.3 You may be liable for a reduction in value if the goods have been used beyond what is necessary to inspect them.

6.4 The right to cancel does not apply to perishable goods once delivered.

7. Food Safety, Labelling and Consumer Information
7.1 We are registered as a food business with the relevant local authority in accordance with UK law.

7.2 We maintain appropriate food safety, hygiene, storage and transportation practices in line with the Food Safety Act 1990 and related regulations.

7.3 Mandatory food information will be provided clearly before purchase and at delivery, including:
  • Name of the food
  • Ingredient list in descending order by weight
  • Allergen declarations for the 14 recognised allergens
  • Net quantity
  • Storage conditions and/or conditions of use
  • Best-before or use-by date
  • Any special instructions
  • Name and address of producer or seller
  • Country of origin (if applicable)
  • Lot or batch number
  • Nutritional information where required
7.4 All information will be provided in a clear and legible format and made easily accessible before purchase.

7.5 All product descriptions, images, and packaging must not mislead consumers about ingredients, allergens, or nutritional quality.

8. Allergies and Dietary Warnings
8.1 We do not guarantee that boxes are allergen-free. Products may contain or come into contact with nuts, gluten, dairy, soy, eggs or other allergens.

8.2 You are responsible for checking ingredient labels and allergen disclosures before consuming any product. If you have severe allergies or dietary restrictions, you should not subscribe unless suitable options are clearly available.

8.3 We accept no liability for allergic reactions or dietary sensitivities except to the extent such liability cannot be excluded by law.

9. Modifications to the Service or Terms
9.1 We may change the box format, delivery partners, pricing or product range from time to time.

9.2 We will give reasonable advance notice, typically 30 days, of any significant change. You may cancel before such changes take effect.

9.3 Updated Terms will take effect at the time of renewal unless otherwise stated.

10. Intellectual Property and User Content
10.1 All rights in our branding, logos, website content and trademarks remain the property of IPOC Limited T/A Candy4U or its licensors.

10.2 By tagging, posting or sharing content featuring Candy4U products and granting permission for reposting, you grant IPOC Limited T/A Candy4U a non-exclusive, royalty-free licence to use that content across our digital platforms and marketing materials.

10.3 You may request removal of your content by contacting us, and we will act within a reasonable time.

11. Account and User Responsibilities
11.1 You are responsible for keeping your account details, address and billing information accurate and up to date.

11.2 You must notify us promptly of any changes to your payment method or contact details.

11.3 We may send important account or billing notifications by email. Please check your spam or junk folders.

12. Termination and Suspension by Us
12.1 We may suspend or terminate your subscription if you breach these Terms, fail to make payment, or we suspect misuse or fraud.

12.2 If we terminate during an active billing period, we will not normally issue a refund unless exceptional circumstances apply, such as our inability to supply goods.

13. Limitation of Liability
13.1 Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, or any other liability that cannot be excluded by law.

13.2 Our total liability for loss or damage arising from these Terms will not exceed the total subscription fees you have paid in the previous 12 months.

13.3 Nothing in these Terms affects your statutory rights as a consumer under UK law.

14. Complaints and Dispute Resolution
14.1 If you have a complaint, please contact us at info@candy4u.co.uk 

14.2 We aim to respond within 14 days and to resolve issues promptly.

14.3 If you are not satisfied, you may refer the matter to an alternative dispute resolution (ADR) body or your local Trading Standards office.

14.4 These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

15. Miscellaneous
15.1 If any provision of these Terms is held invalid or unenforceable, the remainder shall continue in full force and effect.

15.2 Any waiver of breach must be in writing to be effective.

15.3 These Terms, together with any documents referred to within them, constitute the entire agreement between you and us regarding your subscription.
